TERMS AND CONDITIONS
By enrolling into programs offered through OzCode Academy, the applicant and parent acknowledge and agree to our Terms and Conditions as specified below. You acknowledge that our ability to deliver the program is dependent upon your cooperation, the cooperation of your child, as well as the accuracy and completeness of any information you provide to us.
General Conditions of Use and Obligation
1. In order for programs run by OzCode Academy to be safe, ground rules will be explained to your child on arrival at the program. If your child misbehaves repeatedly, and the issue cannot be resolved by an instructor, the parent/carer will be informed.
2. OzCode Academy reserves the right to refuse admission of any student who, in its opinion, may impact the learning of other students or is a safety and security risk to others in the program. We may request any person in breach of the regulations to leave the premises where the course is held and all fees paid will be forfeited.
3. You and your child or minor must use OzCode Academy’s equipment solely as agreed with management and for no other purpose.
4. OzCode Academy accepts no responsibility for any injury incurred during workshops nor any subsequent cost related to that injury.
5. Parents and guardians are solely responsible for the safety of the students before and after class.
6. In case of an accidents where immediate medical care is required, children will be sent to the nearest hospital. By accepting OzCode Academy’s terms and conditions, you have given us your consent to do so.
7. OzCode Academy takes no responsibility for the loss or damage to your child’s personal property, including money or other valuable items.
8. Your child must not undertake any illegal activity on site.
9. You or your child must not record images of persons unaffiliated to you, unless it is with their prior consent and in the case of minors the prior consent must be from their legal guardians.
10. You and your child must leave the facility and/or the equipment in a tidy, safe and proper condition to the reasonable satisfaction of OzCode Academy.
Enrolment
Confirmation of your child’s enrolment is only upon completion of registration on our website and receipt of full payment through EFT.
1. OzCode Academy reserves the right to reschedule or cancel a student’s enrolment at any time due to the class size of less than a minimum of 5 students per class.
2. OzCode Academy reserves the right to change the instructor for programs as deemed necessary and is not required to provide prior notice for such arrangements.
3. Requests to switch or skip programs or levels will be subject to OzCode Academy’s assessment and course availability.
Order Acceptance, Withdrawals, Refunds and Cancellations
1. Students must settle all course fees at least 2 weeks prior to the course commencement.
2. All fees are calculated according to the published rates on the website. We reserve the right to change course prices at any time. In the event of such change, confirmed registrations will be honoured at the original price.
3. Classes run for a fixed duration i.e. a certain number of classes per term as indicated on the webpage (www.ozcodeacademy.com) and no pro rata payment will be accepted, unless offered due to a public holiday.
4. Program fees are non-refundable once the student’s placement has been confirmed.
5. OzCode Academy will provide a confirmation notice after receipt of a valid method of payment.
6. OzCode Academy does not provide refunds on program fees, except in the event that the student’s application for enrolment is not accepted or the program is cancelled.
7. For program withdrawal, notice should be given at least one week prior to the start of the program. All withdrawals will be charged an administration fee of $50.
8. Unless otherwise specified or agreed in writing by us, all courses shall commence on the date specified by us in the order confirmation. We reserve the right to change or cancel training events up to 3 business days prior to the class start date.
9. We will use reasonable efforts to give notice of cancellation. If the course cannot be rescheduled, you will be entitled to a refund of any fee paid in respect of the cancelled services but shall not otherwise be entitled to any compensation, costs, losses or damages arising from such cancellation.
Program Arrangement
1. OzCode Academy reserves the right to make any changes to the program including curriculum, class size, class time, number of classes. This may be to the customer’s advantage or disadvantage.
Warranty
1. We warrant that all OzCode Academy programs will be provided in accordance with generally recognised commercial practices and standards.
2. We make no other warranty or representation as to the suitability or quality of the OzCode Academy Programs. We expressly disclaim all liability for anything done or omitted in reliance upon the OzCode Academy programs and materials. You shall have sole responsibility for fulfilling any requirements or accomplishing any objectives for which you purchased any OzCode Academy programs.
Matters Relating to Service
1. You agree to indemnify, defend and hold harmless OzCode Academy, and its officers, directors, employees, consultants, advisors, agents and representatives from any and all claims, liability, damages, and costs (including, but not limited to, attorneys’ fees, costs and expenses) that result from, arise out of or are in any way connected with your or that of your child’s use of the OzCode Academy programs, your breach of these T&C’s, or your infringement of any OzCode Academy’s IP or other right of OzCode Academy or any third party. These T&C’s will inure to the benefit of the parties and their successors, assigns, licensors and licensees.
Intellectual Property
1. All Course Materials provided are the copyrighted works of OzCode Academy or the original content provider. Unless otherwise set forth, the materials are provided for the sole use of the person attending the program and may not be used by any other person and may not be reproduced, distributed or modified without the written permission of OzCode Academy.
2. We make no warranty, express or implied, as to the suitability, accuracy or reliability of any program material provided through the OzCode Academy programs.
Remedies and Liabilities
1. OzCode Academy’s total liability to you for any reason and upon all claims and causes of action hereunder will be limited to the amount of fees paid by you for the program giving rise to the claim or cause of action. This limitation applies to all causes of action or claims including without limitation breach of contract, breach of warranty, negligence, strict liability or other torts. In no event will OzCode Academy be liable for any consequential, special, indirect, incidental or punitive damages, including without limitation loss of data, loss of profits or loss of savings or revenue, even if it has been advised of the possibility of such damages.
2. In no event will any cause of action be brought against OzCode Academy more than one year after the cause of action has accrued.
3. The remedies in these T&Cs are your sole and exclusive remedies.
4. The parties understand and agree that, to the extent permitted by applicable law, the foregoing exclusions and limitations of liability represent the parties’ agreement as to allocation of risk between them in connection with their respective obligations hereunder. The fees payable to us reflect, and are set in reliance upon, this allocation of risk and the exclusions and limitations of liability set forth in these terms and conditions.
5. Disputes arising in connection with these T&Cs will be governed by the laws of the Australian Capital Territory, Australia.
6. If any term or provision herein is determined to be illegal or unenforceable, the validity or enforceability of the remainder of the terms or provisions herein will remain in full force and effect.
7. Neither party’s failure to exercise any of its rights under these T&Cs will constitute or be deemed a waiver or forfeiture of those rights.
8. These T&Cs and, any applicable amendment, constitute the entire agreement between us and supersede any previous communications, representations or agreements between the parties, whether oral or written, regarding transactions hereunder.
9. Your purchase will constitute your acceptance of these T&Cs which T&Cs may not be changed except by an amendment signed by an authorized representative of each party.
